Use of Our Website

You agree to use our website and services only for lawful purposes. You must not attempt to disrupt, damage, or gain unauthorised access to our website. We reserve the right to suspend or block access if we suspect misuse.

Our Services

We provide web design, app design, and related digital services. The scope, timeline, and pricing of services are agreed upon individually with each client through a contract, email, or written proposal. Deliverables remain the intellectual property of Black Shark Agency until full payment is received, unless otherwise agreed in writing.

Payments & Billing

Payments can be made directly via email, WhatsApp, or other agreed communication channels. We may utilise third-party payment providers (such as PayPal, Wise, or bank transfers). Invoices must be paid in the agreed currency and within the specified timeline. Late payments may result in project delays or suspension of services.

Intellectual Property

All original content, code, and designs created by Black Shark Agency remain our intellectual property until full payment is made. After full payment, rights to the final deliverables are transferred to the client, with the exception of any third-party materials used under license. Clients may not resell, redistribute, or claim ownership of the work without a written agreement.

Client Responsibilities

Clients are responsible for providing accurate and timely information, content, and approvals necessary for project completion. Clients must ensure they have the rights to use any content they provide, including text, images, and logos.

Limitation of Liability

Our website and services are provided "as is" and "as available." To the maximum extent permitted by law, Black Shark Agency is not liable for indirect, incidental, or consequential damages arising from the use of our website or services. Our total liability for any claim is limited to the amount paid by the client for the specific service.

Termination

Either party may terminate a project or agreement if the other party breaches these Terms. Upon termination, the client is required to pay for all work completed up to the termination date.

Third-Party Tools & Services

We may use third-party tools to operate our website and deliver services, including:

  Gmail, WhatsApp.

The use of these tools is subject to their own terms and privacy policies.

Governing Law

These Terms are governed by the laws of Ukraine, without regard to conflict of law principles. Services are provided globally, and we will comply with applicable consumer protection laws in the client's country.

Regional Differences
